In the case of Zoraida Martinez and Expedicto Montan v. Carlos A. Pena, Juan Santos, Silver Bricks Inc., Consolidated Edison Company of New York and M&A Tavern LLC d/b/a MCDERMOTT’s PUB, New York County Supreme Court Index Number 161979/2014, MMG Associate Siobhain A. McSweeney obtained a jury verdict absolving MMG’s client from liability, with 100% of fault assigned to the co-defendant at trial.
This case arose from a motor vehicle accident involving multiple motor vehicles. The plaintiffs filed suit against a number of parties, including MMG’s client, claiming that he was partially at fault for the accident. A unanimous jury dismissed the plaintiffs’ cause of action against MMG’s client after determining that the motor vehicle accident at issue was wholly caused by the actions of the co-defendant.
