MMG Associate Eddy Maffia successfully lowered awarded damages from $40,000 to $15,000 in arbitration for injuries arising from a motor vehicle accident. Plaintiff alleged that her vehicle was T-boned by the Insured, who went through a stop sign and struck Plaintiff’s vehicle at the intersection at a high rate of speed. Plaintiff alleged that the accident led to injuries, including cervical and lumbar herniations. Plaintiff claimed that these injuries limited her ability to perform daily activities. Mr. Maffia introduced expert witness reports refuting Plaintiff’s claims, and on cross examination Plaintiff admitted her limitations had been misrepresented.
The Arbitrator highlighted Mr. Maffia’s concerns, ultimately rejecting the Plaintiff expert’s assessment and awarding $15,000 in damages.
